Terms of Service

These terms govern your use of OpusCue. Please read them carefully — they're written to be clear, not confusing.

These Terms of Service ("Terms") constitute a legally binding agreement between you and OpusCue ("we", "our", or "us") governing your access to and use of the OpusCue platform, including the website at opuscue.com and all related services (collectively, the "Service").

By creating an account or using the Service, you confirm that you are at least 13 years old (or 16 years old in the EU) and that you agree to be bound by these Terms. If you do not agree, please do not use the Service.


1. The Service

OpusCue is an AI-powered platform that helps YouTube creators generate thumbnail concept prompts and video title ideas. The Service is currently offered in Public Beta.

  • During the Beta period, the Service is provided free of charge with a credit-based generation system.
  • Beta access may be subject to limitations on usage, availability, or features without prior notice.
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time, including during Beta.

2. Your Account

To use OpusCue, you must create an account. You are responsible for:

  • Providing accurate and up-to-date registration information.
  • Keeping your password confidential and not sharing your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately at support@opuscue.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.


3. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Use the Service to generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Attempt to reverse-engineer, scrape, or extract data from the Service in an automated or unauthorized manner.
  • Use the Service to generate misleading, deceptive, or fraudulent content intended to harm others.
  • Circumvent, disable, or otherwise interfere with security features of the Service.
  • Share, resell, or sublicense access to the Service without our written permission.
  • Upload or submit any content that infringes the intellectual property rights of a third party.
  • Use the Service for any purpose that could harm OpusCue, its users, or third parties.

Violation of these acceptable use rules may result in immediate account suspension or termination.


4. Credits & Beta Access

During the Public Beta, OpusCue operates on a credit-based system:

  • New accounts receive a free allocation of generation credits upon registration.
  • Credits are consumed each time you generate thumbnails or titles.
  • Credit balances and allocation policies may change as we develop the product.
  • Credits issued during the Beta have no monetary value and are non-transferable.

We may introduce paid plans after the Beta period ends. We will provide advance notice before transitioning to any paid model.


5. Intellectual Property

Your content:

You retain ownership of any prompts, inputs, and descriptions you provide to the Service. By submitting inputs, you grant us a limited, non-exclusive licence to process them solely for the purpose of generating your requested outputs.

Generated outputs:

You own the AI-generated thumbnail concepts and title suggestions produced for you. However, because AI outputs are generative and may contain similarities to content produced for other users, we make no warranty of uniqueness or exclusivity.

OpusCue IP:

The OpusCue name, logo, design, software, and all underlying technology remain our exclusive intellectual property. Nothing in these Terms transfers any rights in OpusCue IP to you.


6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.


7. Disclaimers

The Service is provided on an "as is" and "as available" basis, particularly during the Beta period. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Guarantees that the Service will be uninterrupted, error-free, or free of harmful components.
  • Guarantees regarding the accuracy, reliability, or quality of any AI-generated output.

AI-generated content is produced by large language and image models and may occasionally produce unexpected, inaccurate, or imperfect results. You are responsible for reviewing and using outputs appropriately.


8. Limitation of Liability

To the maximum extent permitted by applicable law, OpusCue and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the greater of (a) the total fees you paid to OpusCue in the 12 months preceding the claim, or (b) USD $10.


9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if:

  • You violate these Terms or our Acceptable Use Policy.
  • We determine that continued access poses a risk to the Service or other users.
  • We discontinue the Service or a material portion of it.

On termination, all licenses granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.


10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, notifying you via email or an in-app message. Continued use of the Service after changes constitutes your acceptance of the updated Terms.


11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation first, and thereafter through binding arbitration or the courts of the applicable jurisdiction.
